Welcome to My Roof Agent (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our services, including our website, inspection services, and contractor bidding platform (collectively, the “Services”).

By using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Overview of Services

My Roof Agent provides an independent inspection and contractor matchmaking service for residential roofing projects. We conduct comprehensive inspections, generate detailed reports, and allow vetted local roofing contractors to bid on the defined project scope.

We do not perform any roofing, construction, or home repair work. Our role ends when the homeowner and selected contractor enter into a contract.

2. No Fees for Homeowners

Homeowners incur no charges for our inspections, reports, or matchmaking services. We do not act as a sales agent for any specific contractor. Our goal is to create a transparent, unbiased bidding environment that protects the homeowner.

3. Contractor Participation

Contractors must apply to be part of our closed, invite-only platform. We reserve the right to approve or deny access at our sole discretion. Contractors must:

• Accurately represent their capabilities.
• Submit bids based on inspection data only.
• Not contact homeowners directly unless awarded a bid.

There are no membership or subscription fees. Contractor access is based on past performance and adherence to our standards.

4. Information Ownership and Access

All data gathered during our inspection process — including photographs, drone footage, written assessments, and visual observations — remains the intellectual property of My Roof Agent unless and until a homeowner formally selects a contractor and signs a contract with them.

At that point:

• The inspection data is transferred to both parties.
• The contractor receives homeowner contact information.
• My Roof Agent is no longer involved, responsible, or liable.

5. Privacy & Data Use

We collect limited personal information (such as name, address, phone, and email) solely to coordinate inspections and notify contractors of available projects.

We do not sell, trade, or share this data with any contractors unless:

• A contractor is selected through our platform.
• A formal contract is signed between homeowner and contractor.

6. Contractor Anonymity & Transparency

Contractor profiles are not publicly listed. Homeowners are shown only verified project outcomes, reviews, or performance metrics that assist with selecting the right contractor. Names, company information, and direct contact details are shared only after a bid is awarded.

7. Post-Project Follow-Up

Within 30 days of project completion, we conduct a follow-up, hands-free drone and visual inspection from the ground to document the final product and gather feedback from both parties.

We are not responsible for the contractor’s workmanship, warranty, timeline, or communication after the bid is awarded.

8. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent project requests or bids.
• Attempt to bypass our platform to negotiate directly before a contract is awarded.
• Use any of our data or reports outside the scope of our intended process.

If you violate these rules, we may suspend or permanently ban your access — with no liability for loss of access, project opportunity, or damages.

9. Limitation of Liability

My Roof Agent acts solely as an independent intermediary. We:

• Do not guarantee any specific bid pricing, project outcome, or contractor performance.
• Are not liable for delays, damages, or contractual issues between the homeowner and contractor.

By using our Services, you release us from any claims arising from the work performed by the selected contractor.

10. Termination of Service

We reserve the right to terminate access to our Services for any user (homeowner or contractor) who engages in fraudulent activity, violates these Terms, or attempts to undermine the platform.

11. Modifications to These Terms

We may update these Terms at any time. Continued use of the Services after updates constitutes your acceptance of the revised Terms. We encourage you to review them periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
